Terms and conditions of use

Article 1 – Definitions

« Site » refers to this website accessible at the following address: www.kosc-telecom.fr/en.

« User » means any person who visits one or more pages of the Site to consult available information free of charge and/or to benefit from any service deployed by Kosc from the Site.

Article 2 – Object

These general terms (hereafter “Terms and conditions of use” or “Terms”) defined the conditions of use of the Site and available services from the Site.

Site consultation by any User and access to the services deployed from the Site are subject to consultation, prior acceptance and full compliance with these Terms.

Article 3 – Content modification

Kosc reserves the right, at any time, to modify or update all or part of these Terms. The User is therefore advised to regularly refer to the latest version of the Terms permanently available on the Site.

If one or more provisions of these Terms are declared invalid pursuant to a law, regulation or following a final decision of a competent court, they shall be deemed to be unwritten. The other provisions shall remain in force.

Article 4 – Intellectual Property

The Site and all its elements, including texts, articles, brochures, plans, images, illustrations, photographs, databases, software are and remain the intellectual property of Kosc.

Any reproduction, exploitation, redistribution or use, in whole or in part, of the Site elements (except for individual and private consultation on a temporary basis) is prohibited without the prior written consent of the rights holder.

Kosc Telecom trademark, as well as the logo appearing on the Site, are registered trademarks (semi-figurative or not). Any total or partial reproduction of these trademarks or logos made from the Site elements without express authorization of Kosc is prohibited, within the meaning of articles L.713-2 and following of the Intellectual Property Code of French Law.

Article 5 – Liability

5.1 Site access

Given the internet main features, it is understood that:

       Internet data transmission is relatively reliable and could have an impact notably on the time required to access the information,

       Information circulating on the Internet is not protected against possible hijacking or viruses,

       It is the User’s responsibility to take all appropriate measures to protect data, files or programs stored in his system against contamination by viruses or attempted intrusion into his system.

Kosc cannot be held liable for any direct or indirect prejudice that may result from access to the Site, including inaccessibility, loss of data, damage, destruction or viruses that may affect the User’s computer equipment and / or the presence of viruses on its Site.

5.2 Site Content

Site content is provided for information purposes only. Although Kosc strives to provide reliable content on this Site, it cannot guarantee that its content is free of inaccuracies or omissions. It cannot therefore be held responsible for errors or omissions, or for the unavailability of information and services. Consequently, the use of the Site and any information included therein is the sole responsibility of the User. Kosc declines all responsibility for any damage whatsoever, including without limitation direct and indirect prejudice that may result from the use of all or part of the Site content.

Kosc reserves the right, at any time and without notice, to make improvements and/or changes to the content of its Site.

In order to facilitate the User’s navigation, the Site may include links to other sites or Internet sources.

As Kosc has no control over the content of these third-party sites and sources,  Kosc cannot under any circumstances be held liable for the availability of these external sites and sources, and thus declines any responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources.

Article 6 – Language

Only the French version of the Terms may be produced in court.

Article 7 – Applicable Law – Competent court

 

Terms are subject to French Law. In the absence of a settlement agreement, any dispute arising out the validity, interpretation and/or performance, Terms shall be submitted to the competent French court.
